On March 3, 2016, Judge Elihu Berle of the Superior Court for the County of Los Angeles certified a class of current and former tenants against Guardian Arms Pacific, LP, the landlord of a large apartment complex in Los Angeles. The tenants allege they were forced to live through extensive construction, exposing them to asbestos, chemical fumes, and dangerous conditions -- which they allege is a violation of the Los Angeles rent control laws.
The Court also appointed Los Angeles attorney J.R. Howell, Esq., to represent the class.
The developer has denied to Los Angeles city officials that construction on the building has even occurred. City officials initially ordered Guardian Arms to offer the tenants permanent relocation compensation. After the City made this determination, Guardian Arms announced that it was canceling the construction. At this point, city officials closed the case. After City watchdogs had moved on, construction continued.
The class members seek an enforcement of the rent control law and back payment of relocation expenses required by the city's rent control law.
